Kobyna — Terms of Use
Version 1 · Updated 15 September 2026
1. Who we are
Kobyna is a music streaming service published by Kobyna Entertainment ("we", "us"), a French company being formed (société en cours de formation), represented by its founder, Christian Kakesa. Its registration details will be added to these Terms once it is registered, and it will then take over the commitments made on its behalf. Contact: legal@kobyna.com.
These Terms of Use (the "Terms") apply to everyone who uses Kobyna: the website, the web player and any other application or feature we offer (the "Service"). Artists who upload music also accept the Artist Terms, which add to these Terms. How we handle personal data is explained in the Privacy Policy.
By using the Service, or by creating an account, you accept these Terms. If you do not accept them, do not use the Service.
2. Early access
The Service is in early access. This means:
- creating an account is by invitation only;
- listening is free, and no subscription or payment is offered yet;
- features may change, be interrupted or be withdrawn while we build the Service.
We will tell account holders before paid features start, and any payment will be governed by terms you accept at that time.
3. Who can use Kobyna
- You can listen without an account.
- To create an account you must be at least 16 years old. If you are under 16, do not create an account.
- To upload music as an artist or on an artist's behalf you must be at least 18 years old and accept the Artist Terms.
- You must give accurate information when you create an account and keep your password confidential. You are responsible for what happens under your account. Tell us at legal@kobyna.com if you think someone else has used it.
4. What you may do with the music
Kobyna gives you a personal, non-exclusive, non-transferable, revocable right to stream the music and see the related artwork and information, for your personal and non-commercial use, through the Service and the players it supports (for example the playlists it provides).
You must not:
- download, record, copy or save streams, except where the Service itself offers it;
- redistribute, broadcast, sell, rent, or publicly perform the content, or use it in a business (a shop, a café, an event) without the licences that use requires;
- get around access controls, rate limits or technical protection, or access the Service by automated means (bots, scrapers) other than the players and interfaces we provide;
- manipulate plays, listeners or rankings, for example with bots, looping, fake accounts or paid listening;
- use the content, or data from the Service, to train or improve artificial intelligence or machine-learning systems;
- use the Service to break the law or anyone's rights.
The music, artwork and texts belong to the artists and other rightholders who licensed them to us. The Kobyna name, logo and the Service itself belong to Kobyna Entertainment. Nothing in these Terms gives you any other right to them.
5. Rules for content
Artists are responsible for what they upload (see the Artist Terms). On Kobyna it is not allowed to publish content, including music, lyrics, titles, descriptions, artwork and artist names, that:
- infringes someone's copyright, related rights, trademarks or image rights, or uses a sample without permission;
- is sexually explicit artwork, or sexualises minors in any way;
- incites hatred or violence against people because of who they are, harasses, threatens, or glorifies terrorism;
- is otherwise illegal under the laws that apply to it;
- impersonates another artist or person, misleads listeners about who made it, or is spam.
6. How we moderate content
We want you to know how decisions about content are made on Kobyna (Digital Services Act, Art. 14).
- Before publication. Every uploaded track is compared automatically with the music already on Kobyna. A track that looks like a copy of existing music is held for a person to review; it is not published or rejected automatically. Album artwork from artists we have not yet verified is also reviewed by a person before it is shown.
- After publication. Anyone can report content (section 7). We review each report, and we may review content on our own initiative. Reports never hide content automatically.
- What we can do: refuse or remove content, remove artwork, stop showing content in some places, or suspend or close an account.
- Reasons. When we restrict content or an account, we tell the artist concerned why: the facts, the rule or law we relied on, and whether a report prompted it. The only exception is where the law or the authorities prevent us.
- Disagreeing. If you disagree with a decision about your content or your report, reply to our message or write to legal@kobyna.com. A person will look at it again. You can also go to court, or, if you are a consumer, to a mediator (section 12).
7. Reporting content
If you believe content on Kobyna is illegal or breaks these Terms, use Report in the "⋯" menu next to the artist, album or track, or write to legal@kobyna.com. Please give:
- why you believe it is illegal or against the rules, in enough detail for us to assess it;
- where it is (the Service shows us the page you reported from);
- your name and email address, so we can tell you our decision. You may report child sexual abuse material without giving them;
- a statement that your report is accurate and made in good faith.
We confirm receipt with a reference, handle reports diligently and objectively, and tell you our decision. We report content that suggests a crime threatening someone's life or safety, including child sexual abuse, to the competent authorities. Knowingly false reports are a breach of these Terms, and we may stop handling reports from people who often send manifestly unfounded ones.
Point of contact for users and for the authorities of the Member States, the European Commission and the European Board for Digital Services (Digital Services Act, Art. 11 and 12): legal@kobyna.com, in French or English.
8. Suspending or closing an account
You can close your account at any time by writing to legal@kobyna.com from its email address.
We may suspend or close an account, or limit what it can do, if its holder seriously or repeatedly breaks these Terms, infringes rights, publishes illegal content, manipulates plays, abuses reporting, or if the law or a court or authority requires it. We act proportionately, give reasons (section 6) and, except in urgent cases, give notice first. For artists the Artist Terms set out the notice periods.
9. Availability and changes to the Service
We work to keep the Service available and secure, but it is provided as it is and as available, especially during early access. It may be interrupted for maintenance, updates, security or reasons beyond our control, and content may be removed by its artist or by us.
10. Liability
To the extent French law allows, Kobyna Entertainment is not liable for indirect damage, loss of data you did not keep elsewhere, or interruptions of the Service, and is liable only for damage that is a direct and foreseeable consequence of a breach of these Terms by us.
Nothing in these Terms limits or excludes liability for death or personal injury, gross negligence or wilful misconduct, or any right that consumer protection law gives you and that cannot be waived.
You are responsible for your use of the Service and for any damage caused by breaking these Terms.
11. Changes to these Terms
We may update these Terms to follow changes to the Service or the law. We will tell account holders by email and show a notice in the Service at least 30 days before a change takes effect, unless a shorter period is required by law or needed to address a security risk or illegal content. If you do not agree, you can close your account before the change takes effect.
12. Law, disputes and mediation
These Terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live.
Please contact us first at legal@kobyna.com; most problems are solved that way. If you are a consumer and we cannot agree, you will be able to refer the dispute free of charge to a consumer mediator. We will name the mediator here before the Service opens to the public; until then, a consumer keeps every other remedy, including the courts.
Disputes with a business user go to the courts of Paris. A consumer can go to the courts where they live or any other court the law gives them.
13. Other terms
- If a clause of these Terms is found invalid, the rest continues to apply.
- Not enforcing a clause is not a waiver of it.
- These Terms, the Artist Terms (for artists) and the Privacy Policy are the whole agreement about the Service.
- The French version of these Terms prevails over any translation.
