Kobyna — Artist Terms
Version 1 · Updated 15 September 2026
These Artist Terms apply when you upload music, artwork or information to Kobyna, or manage an artist on Kobyna, whether you are the artist or act for one (a manager or a label). They add to the Terms of Use, which also apply to you. If the two conflict on something about your content, these Artist Terms apply.
"We" is Kobyna Entertainment, a company being formed, publisher of Kobyna (details in the Terms of Use). "You" is the person accepting these Artist Terms, and the artist they act for. "Your content" is everything uploaded to or through your artist on Kobyna: recordings, the compositions and lyrics in them, artwork, titles, tags, names and any other information.
1. Joining Kobyna
- During early access, artists join by invitation. We link your account to the artist it manages; only that account can upload for that artist.
- You must be at least 18 years old, and have the legal capacity to accept these Artist Terms.
- If you act for an artist or a company, you confirm that you are authorised to accept these Artist Terms for them, and that they are bound by them.
- Keep your account secure: whatever is uploaded from it is treated as uploaded by you.
2. Your rights and your promises
You keep ownership of your content. Kobyna does not ask for exclusivity: you can distribute your music anywhere else.
Each time you upload, you promise that:
- you own, or control through written agreements, every right needed for Kobyna to use your content as these Artist Terms describe. That means the recording, the composition and lyrics, the artwork, and the names, images and likenesses in it;
- everyone else with rights in it has agreed. That includes co-writers, featured and session performers, producers, your label or distributor, your music publisher, and the owners of any sample;
- no collecting society, publisher or label holds rights that stop you granting the licence in section 3. If you or a co-writer are a member of SACEM or another collecting society, you will tell us before uploading, so that we can check how the rights are licensed;
- your content is lawful and follows the content rules in the Terms of Use;
- the information you give is accurate: titles, credits, track numbers, and the artist name. You do not impersonate another artist.
If any of this stops being true, remove the content or tell us straight away.
3. The licence you give Kobyna
For each piece of your content, you give Kobyna Entertainment a non-exclusive, worldwide licence, for as long as the content is on Kobyna, to:
- host, copy, store and back it up;
- convert it to other formats and qualities (for example streaming formats and loudness levels);
- stream it and make it available to listeners in Kobyna's services and in the players Kobyna supports;
- show its artwork, titles and information, and use short extracts, the artwork and your artist name to present and promote your music and Kobyna (for example on Kobyna's pages or social media);
- compare it with other content to detect copies (section 4).
We may let companies that work for us (hosting, storage, delivery) do this on our behalf, only for running the Service.
Payment. The licence is given in return for the royalty model in section 6. While no payouts exist, it is free of charge.
When it ends. When you delete content, or when your account closes, the licence for that content ends. We stop streaming it straight away. Copies in our backups disappear as backups rotate, within 90 days. We may keep what the law requires, or what we need to handle a claim or a legal request about that content.
4. Checks before publication
- Duplicate check. We compare every track you upload with the music already on Kobyna. A track that looks like a copy is held for a person to review; we then publish it or refuse it, and tell you why.
- Artwork review. Until we trust your artist, new or changed artwork is shown only after a person approves it; your previous artwork stays up meanwhile. We decide which artists we trust, and may stop trusting one, for example after a removal.
- These checks help us, but they do not make us responsible for your content. You remain responsible for it.
5. Removing content
- You can take your tracks down, publish them again, or delete them from the Upload page at any time. Deleting is permanent.
- We can refuse, take down or delete your content, or remove its artwork, if it breaks these Artist Terms or the Terms of Use, if we receive a notice that it is illegal or infringes rights and our review supports it, or if the law, a court or an authority requires it.
- We tell you why: what we did, the facts, the rule or law we relied on, and whether it followed a report. We tell you on your album page and by email when we can, unless the law or the authorities stop us. A track an operator took down cannot be put back by you; write to us if you disagree (section 9).
6. Royalties
Kobyna is building a fan-powered royalty model: what a listener pays goes to the artists that listener actually plays, rather than to a common pool shared by market share.
- During early access, listening is free and nothing is paid. Kobyna records which listeners play which artists, so that attribution already exists when payouts start.
- Payouts need more than these Artist Terms. Before any payment, you will be asked to accept payout terms (rates, periods, statements, tax information, payment details) and to verify your identity. Until then, no amount is owed.
- We do not promise any amount of plays, listeners, revenue or promotion, or a date on which payouts start.
- Plays from bots, loops, fake accounts, paid listening or any other manipulation do not count, and may lead to removal of the content and closure of the account.
7. If a claim is made about your content
If someone claims that your content infringes their rights or is illegal because of a breach of your promises in section 2, you will indemnify Kobyna Entertainment for the resulting damages, costs and reasonable legal fees, and help us defend the claim. We will tell you about the claim promptly and not settle it in your name without your agreement.
This section does not apply to what was caused by our own fault.
8. Suspension and termination
- You can stop at any time: delete your content and ask us to close your account.
- We may restrict, suspend or end your use of Kobyna for a breach of these Artist Terms or the Terms of Use, or because of a legal obligation. Before we restrict or suspend it, or at the latest when we do, we tell you why. Before we end your use of Kobyna altogether, we give you 30 days' notice with reasons, except where the law requires us to stop sooner, where you have repeatedly broken these Artist Terms, or where your content creates an urgent risk (for example illegal content or a serious infringement). During the notice period you can respond, and download your statements once they exist.
9. Questions and complaints
Write to legal@kobyna.com with your artist name and what the question is about. A person answers, and looks at any decision about your content again if you disagree with it. You keep every other right, including going to court.
10. Changes to these Artist Terms
We will tell you by email and in the Service at least 30 days before a change to these Artist Terms takes effect (the law requires at least 15 days), unless a shorter period is required by law or needed to deal with an unforeseen danger. If you do not agree, you can delete your content and end your use of Kobyna before the change takes effect. Uploading new content after that date means you accept the new version.
11. Liability, law and courts
The liability rules of the Terms of Use apply. These Artist Terms are governed by French law. Disputes between Kobyna Entertainment and artists or labels acting as professionals go to the courts of Paris, after trying to settle them amicably through section 9. An artist acting as a consumer keeps the protections and courts consumer law gives them.
